BagEquity Terms of Service

Bag Equity LLC (“BagEquity,” “we,” “our,” or “us”) provides a financial technology
platform for families of youth athletes. By using our App, you agree to these Terms
of Service. Please read them carefully.
Important Disclosure
BagEquity is a technology platform. We do not hold, transmit, or custody customer funds. All deposit accounts are held by Blue Ridge Bank, N.A. (FDIC-insured up to $250,000 per depositor) through our banking partner Unit.co. All payment processing is handled by Stripe, Inc. BagEquity is not a bank, broker-dealer, or investment adviser.
1. Acceptance of Terms
By downloading, installing, or using the BagEquity application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Your continued use of the App after any changes to these Terms means you accept those changes.
2. Service Description
BagEquity is a financial platform designed for families of youth athletes. The App allows parents and guardians to:
- Link bank accounts to categorize sports-related spending
- Automatically calculate and contribute a percentage of spending toward a savings account for their child
- Open and manage joint deposit savings accounts for their child
- Receive contributions from family members and supporters
BagEquity is a technology platform. Banking services are provided by Blue Ridge Bank, N.A. through Unit.co. BagEquity is not a bank, broker-dealer, or investment adviser.
3. Eligibility
To use BagEquity, you must:
- Be at least 18 years of age
- Be a U.S. resident
- Provide accurate and complete registration information
- Complete identity verification as required by law
- Maintain the security of your account credentials
You are responsible for all activity that occurs under your account. If you suspect unauthorized access, contact us immediately at support@bagequity.com.
4. Subscription Plans & Payments
BagEquity offers the following monthly subscription plans:
- Starter: $15/month (1 athlete)
- Family: $25/month (up to 3 athletes)
- Team: $35/month (up to 6 athletes)
- Coach: Free (view-only access for coaches)
- Free Trial: New users receive a 7-day free trial
- Auto-Renewal: Your subscription automatically renews each month unless canceled
- Billing: Charges are processed through Stripe on the same date each month
To cancel your subscription, go to Settings > Manage Subscription within the App.
5. Refunds & Cancellations
Subscription Refunds
- Subscription fees are non-refundable
- You may cancel at any time, and your access will continue through the end of your current billing period
- No partial-month refunds are issued
Chargebacks and Disputes
- If you believe a charge is incorrect, contact support@bagequity.com before filing a dispute with your bank
- We will respond to all billing inquiries within 2 business days
- If you file a chargeback with your bank, your account may be suspended until the dispute is resolved
- Fraudulent chargebacks may result in account termination
Contribution Refunds
- Contributions to savings accounts are non-refundable once processed and deposited into the joint deposit account
- ACH transfer errors will be corrected in accordance with Regulation E
6. Savings Accounts
BagEquity facilitates the opening of joint deposit savings accounts through our banking partner for the purpose of saving on behalf of your child.
- Accounts are held at Blue Ridge Bank, N.A. and are FDIC-insured up to $250,000 per depositor
- Accounts are joint deposit accounts where the parent and child are co-owners (parent must be 18+)
- The parent manages the account; the child gains full access at the age of majority
- BagEquity does not hold, transmit, or custody any funds — all funds are held by Blue Ridge Bank through Unit.co
- BagEquity does not provide investment advice or manage investments
- If investment options are made available in the future, they are options for your consideration only — BagEquity does not select, recommend, or advise on any investment
7. Financial Tracking & Bank Linking
BagEquity connects to your bank accounts through Plaid, a trusted third-party financial data provider.
- Multi-factor authentication (MFA) is required before linking a bank account
- Bank credentials are handled exclusively by Plaid and are never sent to BagEquity servers
- We access transaction data to categorize your sports-related spending
- Spending calculations are used to determine your contribution amount
You can unlink your bank account at any time through Settings > Linked Accounts.
8. Contributions
BagEquity allows family members, coaches, and supporters to make financial contributions to a child’s savings account.
- Contributions may be one-time or recurring
- Contributions are deposited into the joint deposit savings account held at Blue Ridge Bank, N.A.
- Contributors must be 18 years or older
- Contributions are processed via ACH transfer — BagEquity sends instructions to Unit.co, which initiates the ACH transfer through Blue Ridge Bank. BagEquity does not originate, process, or handle ACH transfers directly
- You may cancel or pause recurring contributions at any time through the App
9. Data & Privacy
- All data is encrypted in transit (TLS 1.2+) and at rest (AES-256)
- We do not sell your personal information
- We comply with COPPA for children’s privacy
- Social Security numbers are passed directly to our banking partner and are never stored by BagEquity

10. Prohibited Activities
You agree not to:
- Use BagEquity for money laundering, terrorist financing, or other illegal activity
- Provide false or misleading information during registration or verification
- Attempt to access another user’s account
- Circumvent security measures, rate limits, or access controls
- Use automated tools (bots, scrapers) to access the App
- Structure transactions to avoid reporting thresholds
11. Limitation of Liability
BagEquity is provided on an “as-is” and “as-available” basis.
- We are not financial advisors and do not provide financial, investment, or tax advice
- We are not responsible for decisions made based on information in the App
- Our total liability shall not exceed the amount you paid in subscription fees during the preceding 12 months
- We are not liable for delays, errors, or failures caused by our third-party partners (Unit.co, Plaid, Stripe, Blue Ridge Bank)
Bag Equity LLC makes no warranties, express or implied, regarding the reliability, accuracy, or availability of the service.
12. Dispute Resolution
If you have a dispute with BagEquity:
- Step 1: Contact support@bagequity.com. We will respond within 2 business days.
- Step 2: If the dispute is not resolved within 30 days, either party may initiate binding arbitration.
- Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Arbitration will take place in Denver, Colorado.
- You agree to resolve disputes individually and waive any right to participate in class actions.
Nothing in this section prevents you from filing a complaint with the Consumer Financial Protection Bureau (CFPB) or your state attorney general.
13. Termination
- You may cancel your account at any time through the App settings
- Upon cancellation, your subscription access continues through the end of your billing period
- Custodial account funds remain available and are not affected by App cancellation
- Personal data will be deleted within 30 days of account closure, except data we are legally required to retain
- Financial records are retained for 7 years as required by federal regulations
- We reserve the right to suspend or terminate accounts that violate these Terms or applicable law
14. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Denver, Colorado.
15. Changes to Terms
If we make important changes to these Terms:
- We will notify you by email and in the App
- You will have 30 days to review changes before they take effect
- Continuing to use the App after that means you accept the changes
